BrainyHeads Inc. – Terms and Conditions

1. Acceptance of Terms

By using the BrainyHeads Inc. website or Mindful Salat App, you confirm that:

  • You are at least 13 years old (or the minimum age of digital consent in your jurisdiction).

  • If you are under 18, a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

  • You agree to these Terms and our Privacy Policy

  • You will comply with all applicable laws and regulations.

2. License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to:

  • Download, install, and use the Mindful Salat App on up to 3 Apple devices you own or control.

  • Access and use the Services for personal, non-commercial purposes only.

You may not:

  • Copy, modify, distribute, or create derivative works of the App.

  • Reverse-engineer, decompile, or attempt to extract the App’s source code.

  • Use the App for any illegal, fraudulent, or unauthorized purpose.

3. Registration and Account

To access certain features, you may need to create an account. You agree to:

  • Provide accurate, complete, and up-to-date registration information.

  • Maintain confidentiality of your account credentials.

  • Notify us immediately of unauthorized use by email at (info@brainyheads.com).

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription and Payments

The App may offer subscription plans for enhanced features. By subscribing, you agree to:

  • Pay the applicable fees, which auto-renew unless canceled at least 24 hours before the billing period ends.

  • Manage/cancel subscriptions via Apple ID settings.

  • No refunds, except as required by law or Apple’s refund policy.

  • Family Sharing is not permitted.

(If offering free trials, include: "Free trials convert to paid subscriptions unless canceled before the trial ends.")

5. Intellectual Property

All content, trademarks, and features (including text, graphics, and software) are owned by BrainyHeads Inc. or its licensors.

  • "Mindful Salat" and the BrainyHeads Inc. logo are trademarks. Unauthorized use is prohibited.

  • You may not reproduce, distribute, or exploit any content without prior written consent.

6. User Content

If you submit content (e.g., feedback), you grant us a non-exclusive, royalty-free license to use, modify, and display it for App improvements. We may remove violative or harmful content.

7. Prohibited Activities

You agree not to:

  • Use the App for unlawful purposes.

  • Harass, abuse, or harm others.

  • Interfere with the App’s functionality or security.

  • Use bots, scrapers, or automated tools to access the App.

8. Privacy

Your data is handled per our Privacy Policy. By using the App, you consent to:

  • Data collection (e.g., usage analytics, prayer logs).

  • GDPR/CCPA rights (e.g., deletion requests via info@brainyheads.com).

9. Termination

We may suspend or terminate access at any time for violations. Upon termination:

  • You must stop using the App.

  • Your data will be deleted within 30 days (unless legally required to retain).

10. Disclaimer of Warranties

The App is provided "as is" without warranties. We do not guarantee:

  • Error-free, uninterrupted, or secure service.

  • Accuracy of third-party integrations (e.g., prayer times).

11. Limitation of Liability

To the fullest extent permitted by law, BrainyHeads Inc. is not liable for:

  • Indirect, incidental, or consequential damages.

  • Third-party services or Apple-related issues.

12. Force Majeure

We are not liable for delays caused by events beyond our control (e.g., natural disa

sters, government restrictions).

13. Changes to Terms

We may update these Terms. Material changes will be notified via:

  • Email or in-app alerts.

  • Continued use = acceptance of new Terms.

14. Governing Law & Disputes

  • Governed by California law (excluding conflict-of-law principles).

  • Disputes resolved via binding arbitration (American Arbitration Association).

  • No class actions; claims must be individual.

15. Refund Policy

  • No refunds, except where mandated by law or Apple’s policy.

  • Canceled subscriptions remain active until the billing period ends.

16. Beta Features (If Applicable)

Beta features are provided "as is" and may contain bugs. Use at your own risk.

17. Survival Clause

Sections 5 (IP), 11 (Liability), 14 (Governing Law), and 20 (Severability) survive termination.

18. Entire Agreement

These Terms supersede all prior agreements.
